Effective February 2, 2025, Article 4 of the EU AI Act requires organizations to build an adequate level of AI literacy. This ensures the secure and responsible deployment of AI while mitigating potential liability risks.

Obligation to prove AI competence

EU AI Act

Legal framework & implementation

The EU Artificial Intelligence Act (AI Act) came into effect on August 1, 2024, aiming to ensure the responsible development and use of AI across the EU.

Unlike directives, which require national implementation, regulations apply directly in all member states. This means the AI Act is immediately binding without the need for national adaptation.

Implementation timeline:
  • February 2, 2025: Certain prohibitions and competency requirements take effect.
  • August 2, 2026: The AI Act becomes fully applicable.
  • August 2, 2027: Compliance with product safety regulations is required.


Currently, no national implementation law or official supervisory authority has been established.

What does the EU AI Act say about training requirements?

„Article 4: AI literacy
Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.“

Who is affected by the regulation?

Article 4 applies to “providers and operators” of AI systems.

Providers are organizations or companies that develop and commercially release AI systems.

Operators are those who deploy AI systems in their own processes or services.

Both groups must ensure that everyone involved in the operation and use of the AI system has an “adequate level of AI competence”.

„To their best extent“

The phrase “to their best extent” implies a duty of care, but not a rigid, quantitative requirement (e.g., “at least 20 hours of training”).

Instead, it’s a best-effort approach, where organizations must implement reasonable and proportional measures.

Considering the context of AI use

The regulation specifies factors that should be considered when determining the required AI competence:

  • Employees’ technical background,
  • Their experience with similar systems,
  • Existing training and education,
  • The specific context in which the AI system will be used,
  • The target or user group for the AI system.

This makes it clear that the competence requirements will vary depending on the risk level and complexity of the AI application.

Starting February 2, 2025, employees working with AI must demonstrate adequate AI competence. The European AI Regulation mandates this, making it more of an AI competence proof obligation rather than an explicit training obligation.

So, don’t be confused by this distinction.

The proof obligation arises (at the latest) when a supervisory authority, client, or legal review process asks: “How do you ensure your employees are properly qualified?”

From February 2025, AI system providers and operators must ensure that all employees interacting with AI systems possess the required competence. This could involve internal training programs or workshops, or employees completing qualified external live or e-learning courses.

In practice, many organizations will likely opt for structured training or regular professional development to meet the requirements of Article 4 effectively.
